Failure to Yield

Yield signs are often present at intersections and in areas where two roadways merge to help facilitate the flow of traffic. At traffic lights, vehicles waiting to turn left can often make their turn on a green light, as long as they yield to oncoming traffic that also has a green light. Sometimes people fail to yield to oncoming traffic because they do not notice the yield or do not realize that they have to wait until all traffic has passed. When a driver fails to recognize a yield sign and causes an accident with an oncoming vehicle, the driver who did not yield is typically at fault.

Yield signs are some of the most frequently disregarded traffic signs. Part of the problem with yield signs is that some drivers do not fully understand what it means to yield. A proper yield is not completed by simply slowing down; a yielding driver must wait until all oncoming traffic has passed so that it is safe to enter the lane without obstructing traffic.

If a driver is approaching a yield sign at an intersection that feeds to a congested roadway, he or she must slow or stop and wait until the lane is clear. If there is no oncoming traffic present, the driver approaching a yield sign may pass without stopping.

When one driver fails to yield the right of way to another, the result is often a side collision. At intersections where a motorist fails to yield when turning left, a severe t-bone crash may result. These kinds of crashes can be particularly severe and even deadly for everyone involved.

If you have had an accident caused by a driver who did not yield the right of way, it is important to know that you have a right to seek compensation for your injuries and damages. A bad accident may leave you and your loved ones with costly medical bills, lost wages from time off of work, physical therapy costs, significant vehicle damage, and pain and suffering.
